Referral & Business Growth Program 
- Terms & Conditions

These Terms and Conditions govern participation in the Referral & Business Growth Program in Costa Rica. By participating as a Seller or a Referrer, you agree to these terms. Arcadia Costa Rica Real Estate is simply providing the platform to connect buyers and sellers and has no liability in the payments being made. The user agrees to conduct due diligence before transacting.

I. For Sellers (Listing Properties/Services):
 

1. Eligibility:

   • You must have a valid listing agreement with Arcadia Costa Rica Real Estate to participate as a Seller.

   • You are responsible for the accuracy and legality of all information provided in your listing, ensuring compliance with Costa Rican law.

2. Referral Fee Offering:

   • You agree to clearly state the referral fee you are willing to pay for a successful referral on your listing. Arcadia Costa Rica Real Estate is not involved in this arrangement and is not responsible for the payment of referral fees. You are solely responsible for paying the referral fee to the Referrer.

   • The referral fee is only payable upon successful completion of a transaction (e.g., closing of a property sale, signed service contract) resulting from a direct referral by a Referrer through the Arcadia Costa Rica Real Estate platform.

   • Arcadia Costa Rica Real Estate will not be held responsible for resolving any disputes regarding referral fee payments between Sellers and Referrers.

3. Payment Responsibility:

   • You are solely responsible for paying the agreed-upon referral fee directly to the Referrer upon successful completion of the transaction. Arcadia Costa Rica Real Estate will not be involved in, nor responsible for, this exchange.

4. Image & Content Usage:

   • You grant Arcadia Costa Rica Real Estate and participating Referrers a non-exclusive license to use the images, descriptions, and other content provided in your listing for the purpose of marketing and promoting your listing through the referral program.

   • You are responsible for ensuring that you have all necessary rights and permissions to grant this license.

5. Compliance with Costa Rican Law:

   • You are responsible for ensuring that your listing and participation in this program comply with all applicable laws and regulations in Costa Rica.

6. Program Changes:

   • Arcadia Costa Rica Real Estate reserves the right to modify or terminate the Referral Program at any time.

II. For Referrers (Promoting Listings and Earning Cash):
 

1. Eligibility:

   • The Referral Program is open to anyone, regardless of whether they are licensed real estate professionals or residents of Costa Rica.

2. Referral Process:

   • To qualify for a referral fee, you must directly connect a potential buyer/client to a Seller through the Arcadia Costa Rica Real Estate platform (e.g., sharing a listing link, providing contact information through our system). The closed deal must be demonstrably traced back to your direct referral through our platform.

3. Earning Referral Fees:

   • Referral fees are paid directly by the Seller, not by Arcadia Costa Rica Real Estate. Arcadia Costa Rica Real Estate is not involved in the referral fees, and not responsible for ensuring payment of referral fees,

   • Referral fees are only earned upon successful completion of a transaction resulting from your referral.

4. Responsible Marketing & Image/Content Usage:

   • You are authorized to use the images, descriptions, and other content provided in the listing for the sole purpose of marketing and promoting the listing to potential buyers/clients.

   • Limitations on Usage: You agree to use the listing images and content responsibly and ethically. You MAY NOT:

     • Make false or misleading statements about the property/service.

     • Use the content in a way that is discriminatory, offensive, or harmful.

     • Modify the images or content in a way that misrepresents the property/service.

     • Engage in spamming or other unsolicited marketing practices.

     • Use the content in a way that disparages or reflects negatively on the Seller, Arcadia Costa Rica Real Estate, or the property/service. This includes, but is not limited to, making negative or critical comments about the property, neighborhood, or seller.

   • Arcadia Costa Rica Real Estate reserves the right to disqualify any Referrer from the program if they are found to be misusing the listing content or engaging in unethical or harmful marketing practices.

5. Independent Contractor Status:

   • You are participating in the Referral Program as an independent contractor. Nothing in these terms shall be construed as creating an employment, partnership, or agency relationship between you and Arcadia Costa Rica Real Estate.

6. Compliance with Costa Rican Law:

   • You are responsible for ensuring your participation in this program complies with all applicable laws and regulations in Costa Rica. This includes, but is not limited to, advertising regulations and tax obligations on any referral fees earned.

7. Program Changes:

   • Arcadia Costa Rica Real Estate reserves the right to modify or terminate the Referral Program at any time.

III. General Terms (Applicable to Both Sellers and Referrers):

1. Disclaimer of Liability: Arcadia Costa Rica Real Estate is not responsible for any disputes between Sellers and Referrers, or for any losses or damages arising from participation in the Referral Program. The user is responsible for doing their own due diligence and Arcadia Costa Rica is not responsible for any outcomes.

2. Governing Law: These Terms and Conditions shall be governed by and construed in accordance with the laws of Costa Rica.

3. Currency: All fee amounts referenced are assumed to be in United States Dollars (USD) unless explicitly stated otherwise.

4. Entire Agreement: These Terms and Conditions constitute the entire agreement between you and Arcadia Costa Rica Real Estate with respect to the Referral Program.
